OKLAHOMA CITY – Attorney General Mike Hunter today sent a letter to President Joe Biden and congressional leaders explaining their proposal to pack the U.S. Supreme Court undermines the constitutional system, public confidence in the courts and the rule of law.

Court packing is the practice of changing the composition of judges on a specific court by increasing the number of seats, thus tipping the balance of power toward one political party. Recently, President Biden formed a commission to study expanding the current nine-member bench of the U.S. Supreme Court.

OKLAHOMA CITY – Attorney General Mike Hunter today sharply rebuked Pres. Joe Biden’s Interior Department’s Office of Surface Mining Reclamation and Enforcement for its attempted takeover of regulating coal mining and reclamation activities on land in Oklahoma subject to the McGirt decision.

OKLAHOMA CITY – Attorney General Mike Hunter today released the following statement after the Oklahoma Court of Criminal Appeals granted a 45-day stay of the state’s case against death row inmate Shaun Bosse, while the attorney general’s office prepares to file a petition with the U.S. Supreme Court.

Today’s ruling means Bosse will stay in state custody on Oklahoma death row, rather than be transferred to federal custody, which was previously mandated by the Court of Criminal Appeals.

OKLAHOMA CITY – Attorney General Mike Hunter has filed a lawsuit against A&K Distributors for failing to deliver an order of ventilators to the Oklahoma State Department of Health at the onset of the Coronavirus pandemic.

In the lawsuit, the state claims the Oklahoma State Department of Health paid over $890,000 for 40 ventilators last April. The company had only delivered two ventilators by June 2020.

OKLAHOMA CITY – Attorney General Mike Hunter today filed a brief asking the U.S. Supreme Court to hear a case and overturn a lower court’s ruling on a case surrounding race-based college admissions at Harvard University.

The filing is in support of the organization Students for Fair Admissions in its appeal of a lawsuit against Harvard that claims the university discriminates against Asian-American applicants in its undergraduate admissions process.

OKLAHOMA CITY – Attorney General Mike Hunter today filed a motion requesting the Oklahoma Court of Criminal Appeals to rehear the state’s case against Shaun Bosse, a non-Indian who murdered a Chickasaw family, after the court ruled the state did not have jurisdiction to prosecute him due to the U.S. Supreme Court’s ruling in McGirt v. Oklahoma.

In the petition, the attorney general writes a rehearing is warranted because the court overlooked arguments and authority offered by the state and reached a conclusion that conflicts with the state’s post-conviction statutes.

LAKE CHARLES, LA – Attorney General Mike Hunter today joined a lawsuit to blunt the Biden administration’s continued attack on the oil and gas industry.

According to the lawsuit filed in federal court in the Western District of Louisiana, the president’s recent executive order that placed a moratorium on all oil and natural gas leasing activities on public lands and offshore waters violates the Outer Continental Shelf Lands Act and Mineral Leasing Act. The order unravels longstanding statutory arrangements and terminates benefits states receive from drilling activity.

OKLAHOMA CITY – Attorney General Mike Hunter today announced the appointment of former U.S. Attorney for the Eastern District of Oklahoma Brian Kuester as a special counsel partnering with the OSBI on their investigation into allegations reported to the Attorney General’s Office surrounding the Oklahoma Pardon and Parole Board.

The appointment comes as the Attorney General’s Office continues to receive complaints about the manner in which the Pardon and Parole Board has conducted recent agency actions.
