OKLAHOMA CITY - Oklahoma Attorney General John O’Connor is joining a coalition of 21 states seeking to stop President Biden’s rescission of Title 42 in Arizona v. CDC. The original complaint was filed last week. The coalition is asking the court to move swiftly to protect Arizona and the other plaintiff states from the inevitable massive increase of illegal border crossings if Title 42 is rescinded on May 23rd.
“President Biden has failed to fix the immigration crisis at the southern border,” said Attorney General O’Connor. “His decision to end Title 42 will lead to an unprecedented surge in illegal immigration, bringing increased COVID-19 risks into our communities. At the same time, Biden is requiring our military to be vaccinated or get out but plans to let millions of unvaccinated illegal immigrants into our nation. I will continue to hold the Biden administration accountable for their careless immigration policies that jeopardize communities across Oklahoma.”
Title 42 has been in effect since March 2020 and has been used by both the Trump and Biden administrations to try and keep communicable diseases, like COVID-19, out of the country, and has prevented over 1.7 million illegal entries into the U.S.
The Attorneys General argue that revoking Title 42 violates the Administrative Procedure Act (APA) because it is arbitrary and capricious, and that the Biden administration did not conduct the statutorily required notice and comment process.
Attorney General O’Connor is joined by the AGs of Arizona, Louisiana, Missouri, Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Kansas, Kentucky, Mississippi, Montana, Nebraska, Ohio, South Carolina, Tennessee, Utah, West Virginia, and Wyoming.
